Can Osinbajo Waive Immunity For Prosecution?
ElevateNews takes a look at the threat by Vice President Yemi Osinbajo to sue Timi Frank.
I see Timi Frank going into political oblivion after his N90 billion allegation against Vice President Yemi Osinbajo. He will sink naturally even if the professor will not waive his immunity to seek redress about his defamation of character by the estranged former Deputy National Publicity Secretary of the All Progressives Congress.
Frankly speaking, Frank is on a fool’s errand and will blame himself for throwing caution to the wind for his defamatory message. Osinbajo said that he would be ready to waive his immunity so that he could charge the Frank to court but one Akinloye NG. BA, MLS, a Legislative Expert and Public Affairs Analyst said that the vice president could not waive his immunity.
As he put it, “Except he’s in connivance with the cabal using that as an exit point to pave way for his replacement.”
He explained that Immunity is constitutional and can only be tampered with by passage of an amendment Bill by the NASS and approved by 2/3rd of States.
To him, waiving constitutional immunity is stepping down by resigning as the Vice President so that the Economic and Financial Crimes Commission (EFCC) could investigate the allegation.

A former Governor of Ogun State, late Olabisi Onabanjo waived his immunity and sued Concord newspapers for defamation. He won the case. When Adams Oshiomhole was the governor of Edo State, he also waived his immunity and sued a national newspaper that reported a false story that he impregnated a university undergraduate. He won the case.
The problem with some lawyers nowadays is that they no longer do any research. They talk more of politics than law by saying that Osinbajo cannot waive his immunity.

There are still members of the APC in the present administration that are loyal to the faction of Frank but are bent on causing disharmony in the presidency.
Despite the noise, Osinbajo presided over the Federal Executive Council meeting on Wednesday in which he approved over N100 billion for the repair of Ibadan-Ife-Ilesha Road. He has remained unperturbed regardless of the plot to dent his integrity by the mafia in Aso Rock.
However, Frank was quick to react, saying that waiving the immunity would enable the former President Goodluck Jonathan and former President of the Senate, Bukola Saraki to charge Osinbajo himself.
Frank asked Osinbajo to provide evidence of the various allegation of corruption against the two leaders as soon as he has waived his immunity.
Is it not surprising that Frank who was a former Deputy National Publicity Secretary for APC is now working for the Peoples Democratic Party even though he had not declared his defection publicly.
